What Information do we collect, and what do we do with it?

Website

We use cookies to remember you. You can turn off most cookies and learn more at our Cookie Policy page. We use customer relationship management software that helps us document your consents, preferences, and contact information; we use this information to contact you, respond to your requests, and keep records of how we resolved any concerns. We use website analytics tools that provide us with anonymized website traffic and click information. We use this information to improve our website’s visual aesthetics, make information easier to find, and generally provide you with a great experience that gets even better over time when you visit our website.

Contact and Customer Service Information

When you provide contact information or billing information to submit a request or open an account or make a payment, we will collect and use that information to respond to you or conduct the requested transaction. In many cases, we will also make a record of what we did. For example, if you submit a help desk request, and we respond to that request, we’ll also keep a copy of that conversation in case you need help again, and we need to remember where we left off.

General Feedback, Surveys, and Reaching Out to Us

You’re not going to believe this, but if you submit feedback, we’re going to read it! So, whatever you write to us might get shared in our office as we respond and help you as best as we can. Please also note that any suggestions or feedback sent to us will not be treated as your intellectual property.

Automated Collection

If you swing by our website on the way to any of our other products, that website does use cookies. As a reminder, those cookies are there to make sure the website works, not sell you anything.

On the website and within the app, we do collect anonymous information about how people are working with and exploring the website or app, and information about how people are accessing our products (for example, your mobile device type). We use that information to give you a nice experience using our products that get even nicer over time, identify bugs, or do things like make sure we allocate the right amount of computer resources in the right places. After all, we don’t want to be wasteful! 

Billing Information

We will collect standard billing information when fees are due. We keep records, including transaction details and related contact information, when we charge money for anything. That keeps our accountants happy.

What Else Do We Do With Your Information?

(1) We have some compliance and customer service responsibilities that will require us to record and hold information about your account, but only in the good ways that you’d expect; and (2) We collect some data that allows us to create statistics and analyze how well our products work and if we can make them better. 

Overall, we generally make sure that we treat your personal data respectfully and securely, no matter who you are or where you live.

Third Parties

We work with some third parties. For example, we work with third parties to store information in databases or process payments. Although we are not responsible for third party product or service issues, we value your feedback regarding your use of these third parties and their terms.

Data Rights

Everyone has rights to their data. It is yours, after all. So whether you live in a place like California or the EU that has put many of these rights into a law, or you live at sea and are governed only by the sun and waves, we respect your data rights, and you can submit data-related requests to privacy@arcatar.com. Kids

People under 18 should not use our website unless a parent or guardian approved it. If you are that parent or guardian, please use extra care to help the younger ones use our Site and Services responsibly.

Data Transfers

Our databases are located in the USA, so if you are located outside the USA, data will be transferred to our servers in the USA. Generally regarding data transfers, we seek to follow best practices regarding all cross-border data transfers utilizing adequacy decisions, standard contractual clauses, and encryption and security practices as our guideposts for safely and securely handling and transferring data. Changes and Updates

If you want to change or update your settings, including withdrawal of consent for something, check out your account settings or contact Customer Service. If we want to change something, be it this policy or something about how our Site or Services or products work, we can do so. When changes are made, you will be notified as long as we have your contact information. Otherwise, it is up to you to come back from time to time for updates. 

PRIVACY NOTICE FOR CALIFORNIA RESIDENTS 

Effective Date June, 2023 

This Privacy Notice for California Residents (“Notice”) supplements the information contained in this Policy and included above, and applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this Notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice. 

Information We Collect 

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("Personal Information"). Personal Information does not include: 

  • Publicly available information from government records.

  • Deidentified or aggregated consumer information.

  • Information excluded from the CCPA's scope, such as health or medical information covered by HIPAA and the California Confidentiality of Medical Information Act (“CMIA”) or clinical trial data. 

Given our history, the Product has no preceding twelve (12) month historical data on information collected from California residents. Nevertheless, the Product may collect the following categories of personal information from consumers:

arcatar does not sell your information. Please review the What we do with the information that we collect and why we collect it section above, as well as the remainder of this Notice. 

We use and partner with different types of entities to assist with our daily operations and manage our Services. Where we refer to or mention these other entities, we recommend that you review those companies’ privacy policies, which control their services provided to us, to ensure you agree with those policies.  

Use of Personal Information  

  • We collect and use personal information for business and commercial purposes in accordance with practices described in this Policy and our Terms and other related documentation (which is incorporated by reference into this Privacy Policy) including one or more of the following business purposes: 

    • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to create an account or ask a question about our products or Services, we will use that personal information to verify who you are and respond to your inquiry. We may also save your information to manage the account or profile set up when you sign up for a validated arcid. 

    • To provide, support, personalize, and develop our Site and Services. 

    • To create, maintain, customize, and secure your account with us. 

    • To process your requests, purchases, transactions, and payments and to prevent transactional fraud. 

    • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses. 

    • To help maintain the safety, security, and integrity of our Services, databases and other technology assets, and overall business. 

    • To help prevent and address fraud, breach of policies or terms, and threats or harm. 

    • Sending you technical notices, updates, security alerts, information regarding changes to our policies, and support and administrative messages. 

    • For testing, research, analysis, and product development, including to develop and improve our Site or Services. 

    • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. 

    • As described to you when collecting your personal information or as otherwise set forth in the CCPA. 

    • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, other sale or transfer of some or all of our assets, or another similar business transaction, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred. 

    • To fulfill any other business or commercial purposes at your direction or with your notice and/or consent. 

Your Rights and Choices 

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.  Please note that if we do not possess data that can be associated with you (i.e. only aggregated data), we may not be able to respond to your request beyond a statement that confirms our inability to satisfy a request due to the fact that we do not possess any such data (I.e. Personal Information). 

Right to Know 

You have the right to request that we disclose certain information to you about our collection and use of your personal information in the preceding 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you, based upon your request: 

  • The categories of personal information we collected about you. 

  • The categories of sources for the personal information we collected about you. 

  • Our business or commercial purpose for collecting that personal information. 

  • The categories of third parties with whom we share that personal information. 

  • The specific pieces of personal information we collected about you (also called a data portability request). 

  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:  

    • sales, identifying the personal information categories that each category of recipient purchased; and / or

    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained. 

Right to Delete 

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to: 

  • Complete the transaction for which we collected the personal information, provide goods or services that you requested or that was requested on your behalf, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty, or otherwise perform our contract with you. 

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities. 

  • Debug products to identify and repair errors that impair existing intended functionality. 

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law. 

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.). 

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us. 

  • Comply with a legal obligation. 

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it. 

Exercising Your Right to Know and Right to Delete 

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either: 

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. The verifiable consumer request must provide enough information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include: 

  • First and last name, email address, date of birth and username (as applicable). 

  • Description of your request with enough details that allow us to properly understand, evaluate, and respond. 

We cannot substantively respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you, except where the CCPA does not require a verifiable request for a response. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. 

You may only make a consumer request for access or data portability twice within a 12-month period. 

Response Timing and Format 

We endeavor to respond to a consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing to the email address that you provide to us.  We cannot be responsible for a failure to respond if you do not update your email address where we may reach you.   

Any disclosures we provide will only cover the 12-month period preceding the consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. 

Right to Opt-Out and Opt-In 

arcatar does not sell personal information, however, you may do so if you choose such option. Nevertheless, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). Consumers who opt-in to personal information sales may opt-out of future interactions at any time. 

Non-Discrimination 

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: 

  • Deny you goods or services. 

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties. 

  • Provide you a different level or quality of goods or services. 

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 

Other California Privacy Rights 

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Product and Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.  In particular, customers who are residents of California may request:  

  • a list of the categories of personal information disclosed by us to third parties during the immediately preceding calendar year for those third parties’ own direct marketing purposes; and  

  • a list of the categories of third parties to whom we disclosed such information.

UPDATES TO THIS POLICY 

We reserve the right to make updates and revisions to this Notice at our discretion and at any time. When we make changes to this Notice, we will post the updated notice on the Product and update the effective date. Any changes will be effective as of the “Updated” date. Your continued use of the Product following the posting of changes constitutes your acceptance of such changes.
